General Terms and Conditions (GTC)

1. Scope
1.1 These GTC apply to all contracts for the purchase of goods between xtraqt GmbH, General-Wille-Strasse 15, 8002 Zürich, Switzerland ("we"), and its customers ("you") that are concluded
a) through the online shop at www.monqzi.com, including Shopify's checkout;
b) with business customers by email, phone or written order;
c) at a MONQZI fridge where we sell ourselves (section 9).
1.2 Consumers are persons who buy goods for their personal or family use. Business customers are companies and persons who buy in the course of their professional or commercial activity, for example hospitality businesses, retailers, gyms or offices.
1.3 Different terms of business customers apply only if we have agreed to them in writing. The version of these GTC in force at the time of your order applies.
1.4 We deliver only to addresses in Switzerland.
2. Ordering in the online shop and conclusion of the contract
2.1 The presentation of the products in the online shop is not a binding offer but an invitation to place an order.
2.2 How to order:
- 1. Choose the product and quantity and add them to the cart.
- 2. Click "Checkout" in the cart. You are taken to Shopify's checkout.
- 3. Enter your contact and delivery details and choose a payment method.
- 4. Check your order with all details, prices and shipping costs. Until you complete the order, you can change your entries at any time or correct them via the cart.
- 5. By clicking the button that completes the ordering process, you place a binding order. Payment is made in the checkout at that point.
2.3 We confirm your order by email without delay. With this order confirmation we accept your order, and the contract is concluded.
2.4 If, exceptionally, a product you ordered is not available, we will inform you without delay and refund any amounts already paid.
2.5 The contract language is German.
3. Orders from business customers (B2B)
3.1 Business customers can order by email, phone or in writing. Enquiries through the B2B form on our website are non-binding; we reply with an offer. The contract is concluded with our written confirmation (email included) or with delivery.
3.2 The prices and terms of the B2B price list in force or of our offer apply. Prices marked "excl. VAT" are subject to VAT in addition.
3.3 Invoices are payable net within 30 days of the invoice date unless otherwise agreed.
3.4 Goods delivered remain our property until paid in full. We may have this retention of title entered in the competent register.
4. Prices and shipping costs
4.1 Prices in the online shop are in Swiss francs (CHF) and include VAT.
4.2 We show you the shipping costs in the checkout before you complete your order.
4.3 We may change our prices at any time. The price at the time of your order applies.
5. Payment
5.1 In the online shop you can pay with TWINT, Visa, Mastercard, Apple Pay or Google Pay (through Shopify Payments) or with PayPal.
5.2 For business customers, section 3.3 applies.
6. Delivery
6.1 We ship from a warehouse in Switzerland, normally with Swiss Post. For larger quantities, other carriers may be used. In the Aargau and Zürich region, we sometimes deliver in person.
6.2 The delivery time is normally 5–8 working days from conclusion of the contract. If a delivery is delayed, we will let you know.
6.3 Benefit and risk pass to you when the goods are handed over to the carrier (Art. 185 Swiss Code of Obligations). If we deliver in person, they pass to you when the goods are handed over to you.
6.4 Please report visible transport damage to the delivery person and to us (info@monqzi.com) as soon as possible, so that we can assert our claims against the carrier.
6.5 If the goods cannot be delivered for reasons for which you are responsible (for example a wrong address, or because a parcel is not collected), we may withdraw from the contract. We refund amounts already paid, less the shipping and return costs incurred.
7. No right of withdrawal or return
7.1 Under Swiss law there is no statutory right of withdrawal for purchases in the online shop. Your order is binding.
7.2 Our products are foods. We do not offer a voluntary right to return goods that are in perfect condition, for example after a mistaken order or if you do not like the taste. Your rights for defective goods (section 8) are reserved.
8. Defects (warranty)
8.1 Please check the goods on receipt, in particular for completeness and for damaged, dented or leaking cans.
8.2 Consumers report defects to us by email to info@monqzi.com, with a photo if possible. The report is in time if it is made within 7 days of receipt of the goods for obvious defects, and within 7 days of their discovery for hidden defects. Business customers must report defects immediately on receipt of the goods or immediately on their discovery (Art. 201 Swiss Code of Obligations).
8.3 If a defect is justified, we deliver perfect replacement goods free of charge. Consumers may instead ask for a refund of the purchase price of the defective goods; their other statutory rights are reserved. For business customers, we either deliver replacement goods or refund the purchase price of the defective goods, at our choice; further warranty claims of business customers are excluded to the extent permitted by law.
8.4 Insignificant deviations in taste, colour or consistency that are due to normal fluctuations in the agricultural raw materials or in filling, and slight damage to the outer packaging that does not affect the contents, are not defects.
8.5 Claims for defects become time-barred two years after delivery of the goods (Art. 210 Swiss Code of Obligations).
9. Buying at a MONQZI fridge
9.1 At some locations, we place a MONQZI fridge at partner businesses. Where we sell there ourselves, xtraqt GmbH is your contracting party. The price and payment method are shown on the fridge; normally you pay with TWINT using a QR code of xtraqt GmbH. The purchase contract is concluded when you take a product and pay for it.
9.2 If the partner business sells the products itself, it is your contracting party. These GTC then do not apply.
9.3 Please report defects to info@monqzi.com. Section 8 applies accordingly.
10. Liability
10.1 We are liable without limitation for damage we cause intentionally or through gross negligence, for personal injury, and under the Swiss Product Liability Act.
10.2 Otherwise, our liability for slight negligence is excluded to the extent permitted by law. Towards business customers, we are also not liable for indirect or consequential damage, in particular for loss of profit.
10.3 These limitations also apply to persons we engage to perform our obligations.
11. Product information
Information on ingredients, allergens and nutritional values, and notes on our products, is on the relevant product page and on the packaging.
12. Data protection
How we process personal data is explained in our privacy policy.
13. Applicable law and place of jurisdiction
13.1 Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
13.2 For consumers, the statutory places of jurisdiction apply (Art. 32 Swiss Civil Procedure Code): for actions against us, the court at your place of residence or at our registered office in Zürich; for actions against you, the court at your place of residence.
13.3 For business customers, the exclusive place of jurisdiction is Zürich.
14. Final provisions
14.1 If any provision of these GTC is invalid, the remaining provisions remain valid.
14.2 These GTC are available in German and in English. If the two versions differ, the German version prevails.
